The landlord must deliver an apartment fit for residential use and matching what was agreed. A blanket exemption clause does not protect a landlord who knew, or should have known, of a defect.

An apartment is not fit for habitation if it lacks any one of: clean water and working drainage; electricity and lighting; ventilation and natural light; doors and windows that close the openings; or if it poses an unreasonable health or safety hazard.
